Terms of service
These terms apply when you use osnerartgallery.com and when you buy from us. By placing an order, you agree to them.
1. Who we are
This website is run by Martin Osner Fine Art Photography CC, registration number CK 2002/037820/23, trading as Osner Art Gallery. Registered and physical address: 14 Luisa Way, Hout Bay, Cape Town 7806, South Africa. Sole member: Mrs Anita Osner. Email: info@osnergallery.com. Telephone: +27 21 790 6494.
2. The artworks
Limited edition prints are signed and numbered by the artist, and come with a certificate of authenticity. When an edition is sold, it closes.
Open edition prints are signed by the artist, not numbered.
Original paintings are one of one, signed by the artist on the painting.
Celebration prints are made from an original painting after it has sold. They carry the printed signature from the original and are not signed again.
All prints are made on archival fine art paper with archival pigment inks. We photograph every work with care, but colours on your screen may differ slightly from the work itself.
3. Copyright
Buying a work gives you the work itself, not the copyright. The artist keeps the copyright. Images on this site may not be copied or reproduced without our written permission.
4. Prices and payment
Prices are in US dollars. Below each price we show an estimate in your own currency, for guidance only, worked out at the day's exchange rate.
You can pay by card through Paygate, by PayPal, or by bank transfer. All card and PayPal payments are charged in US dollars, and before you pay you are shown that clearly, together with the approximate value in rand. Buyers in South Africa may pay by bank transfer in rand, at the exchange rate on the day of payment. When you pay by bank transfer, we email our bank details with your order, and we reserve your work while payment clears.
Card payments are handled on Paygate's and PayPal's own secure, encrypted pages. Your card details are never stored on our site.
We are not a VAT vendor, so no VAT or tax is added to our prices. Any import duty or tax charged by your country on arrival is set by its customs rules and is payable by you.
We do not accept cash.
5. Your order
Every order depends on the work being available. If a work you have paid for is no longer available, we refund you in full within 10 working days.
6. Delivery, returns and refunds
Delivery is free on every work. See our shipping policy and our returns and refunds policy.
7. Commissions
A commission begins with a conversation, in person at the gallery or on a live video call. Size, medium, look and feel, price and timing are agreed with you before any paint goes on the canvas. Before the finished painting leaves the gallery, you sign it off with us, in person or on a live video call. For that reason a commission cannot be returned, but if it is damaged in transit a new painting is made for you free of charge.

How we look after your personal information is set out in our privacy policy.
9. Responsibility
We take responsibility for every part of your purchase: the sale, customer service, delivery and resolving any dispute.
10. Law
These terms are governed by the laws of South Africa. For all legal purposes, including notices and court process, we choose 14 Luisa Way, Hout Bay, Cape Town 7806 as our address. Nothing in these terms takes away rights you have under the consumer law of your own country.
11. Changes
We may update these terms from time to time. The terms that apply to your order are the ones on this page when you placed it.
